Neighbor tree disputes in Alameda County: what is different here

Short answer: California law is the same in every county: the trunk decides ownership (Civil Code 833 and 834), you may trim to the line but not injure the tree (Booska v. Patel), damage is a nuisance and hazard is negligence. What changes in Alameda County is which cities give you a view claim, how strictly each city protects the tree, and where you go to resolve it. View claims exist only in Oakland, Berkeley; everywhere else in the county a blocked view is not actionable on its own.

Protected-tree rules

Every Alameda County city with a tree ordinance protects trees above a size or species threshold, which means neither neighbor can remove, and often cannot heavily prune, the tree in dispute without a permit, whatever they agree between themselves. Thresholds, species lists, measurement rules, fees and penalties are catalogued city by city on Urban Forestry Guide, and the report cites the rule that applies to your tree.

What disputes look like here

East Bay hills disputes are view disputes and fire-fuel disputes in the same yard: Monterey pines, eucalyptus and acacias blocking Bay views in Oakland and Berkeley, and the same trees as ladder fuel in the wildland-urban interface. Oakland's view ordinance exempts coast live oak and bay laurel; Berkeley protects only coast live oak on private land. Flatland disputes are the usual roots, fences and sewer laterals, and both Oakland and Berkeley have private sewer lateral ordinances that shape who pays.
